The Department of Homeland Security (DHS) announced the extension of Venezuela’s 2021 Temporary Protected Status (TPS) designation for 18 months and a separate redesignation of Venezuela for TPS for 18 months. DHS has posted a Federal Register notice for public inspection. The Federal Register notice will be published on Oct. 3, 2023.

If You Currently Have TPS or Have a Pending Application (Venezuela 2021)

• If you do not have a pending re-registration application, the 60-day re-registration period for TPS beneficiaries under Venezuela 2021 begins Jan. 10, 2024, and ends March 10, 2024.
  
• If you currently have TPS based on Venezuela’s 2021 TPS designation (Venezuela 2021), you can keep your TPS through Sept. 10, 2025, if you re-register and continue to meet TPS eligibility requirements. If you currently have a pending re-registration application, you do not need to file any additional re-registration application at this time.
  
• DHS recognizes that not all re-registrants may receive a new Employment Authorization Document (EAD) before their current EAD expires. To ensure that these re-registrants do not see their employment authorization lapse, USCIS is automatically extending through March 10, 2025, the validity of certain EADs previously issued to current Venezuela 2021 TPS beneficiaries.
  
• USCIS will continue to process pending applications filed under Venezuela 2021. If you have an initial Venezuela TPS application (Form I-821) or Application for Employment Authorization (Form I-765) pending as of Oct. 3, 2023, under Venezuela 2021, you do not need to file either application again. If we approve your pending Form I-821, we will grant you TPS through Sept. 10, 2025. Similarly, if we approve your pending TPS-related Form I-765, we will issue you a new EAD that will be valid through the same date.

If You Do Not Currently Have TPS and Would Like to File an Initial Application (Venezuela 2023)

• If you do not currently have TPS and you would like to file an initial application, you may do so under the redesignation of Venezuela for TPS (Venezuela 2023).
  
• You are eligible to apply if you:
  • Are a Venezuelan national (or have no nationality and last habitually resided in Venezuela);
  • Have continuously resided in the United States since July 31, 2023; and
  • Have been continuously present in the United States since Oct. 3, 2023.
• Under the 2023 redesignation of Venezuela, eligible individuals who do not have TPS may submit an initial Form I-821, Application for Temporary Protected Status, during the initial registration period that runs from Oct. 3, 2023, through April 2, 2025. You may apply for a TPS-related EAD by submitting a completed Form I-765, Application for Employment Authorization, with your Form I-821, or separately later. You also may apply for travel authorization. First-time Venezuelan TPS beneficiaries under Venezuela 2023 will receive TPS and EADs valid through April 2, 2025.
